We want to ensure complete transparency about how our digital products can be used. While legal terms can seem overwhelming, these guidelines are designed to protect both you as our valued customer and our small business. We've written these terms in clear language to help you understand your rights. If you have any questions, we're always here to help via our support page.

1. GENERAL TERMS

1.1. By purchasing and using any digital products, including digital templates, spreadsheet files, and web-based applications (collectively "the Products") from Bobcat Planners ("we," "us," or "our"), you agree to these Terms and Conditions.

1.2. Age Requirement: The Products and Services are intended only for access and use by individuals at least eighteen (18) years old. By using BobcatOS, you warrant and represent that you are at least eighteen (18) years of age.

2. LICENSE TERMS

2.1. Upon purchase, you receive a non-exclusive, non-transferable, non-sublicensable license to use the purchased Product. Each Product's system requirements (e.g., Microsoft Excel, Google Sheets, or modern Web Browser) are specified in the product description. It is your responsibility to verify your system meets these requirements before purchase.

2.2. Personal Use: You may create multiple copies for your personal use on your own devices and collaborate with specific teammates or family members. Personal use specifically excludes creating derivative products for distribution, sharing through public file-sharing platforms, or providing commercial planning services to others using the Products.

2.3. Prohibited Activities: Redistribution, reverse engineering, removing Bobcat Planners branding, or attempting to bypass security and activation features is strictly prohibited.

3. ACCOUNTS & CLOUD SERVICES

3.1. Account Security: You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for any and all activities or actions that occur under your account. Bobcat Planners is not liable for data loss or unauthorized access resulting from your failure to secure your account.

3.2. Activation: Certain Products require activation using your order number. We monitor IP addresses and activation attempts to prevent unauthorized distribution and fraud.

3.3. Cloud Synchronization (BobcatOS): For BobcatOS applications, cloud synchronization is provided as an optional convenience. You acknowledge that clearing your browser cache, utilizing "Incognito" modes, or hardware failure may result in the permanent loss of data that has not been successfully synchronized to our cloud servers. Bobcat Planners is not responsible for the recovery of data that exists solely in your local browser environment.

4. THIRD-PARTY INFRASTRUCTURE

BOBCATOS AND ALL DIGITAL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE RELIES ON THIRD-PARTY INFRASTRUCTURE PROVIDERS (INCLUDING BUT NOT LIMITED TO SUPABASE, AMAZON WEB SERVICES, RESEND, AND SHOPIFY). YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT BOBCAT PLANNERS IS NOT LIABLE FOR ANY LOSS OF DATA, SERVICE INTERRUPTIONS, OR FINANCIAL LOSS RESULTING FROM THE FAILURE, INSOLVENCY, BANKRUPTCY, OR PERMANENT CESSATION OF OPERATIONS OF THESE THIRD-PARTY PROVIDERS.

5. LIMITATION OF LIABILITY

5.1. We strive for excellence, but we do not guarantee the Products' suitability for any particular purpose or that they will be entirely free of bugs or errors.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT BOBCAT PLANNERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (I) THE USE OR INABILITY TO USE THE SERVICE; (II) ANY BUGS, ERRORS, OR OMISSIONS IN THE SOFTWARE; OR (III) THE ACCIDENTAL DELETION OR CORRUPTION OF DATA.

5.2. Liability Cap: In no event shall Bobcat Planners' total liability to you for all damages, losses, and causes of action exceed the total amount paid by you for the specific Product license.

6. PRIVACY & DATA RETENTION

6.1. Our Privacy Policy is available at bobcatplanners.com/privacy and is incorporated into these Terms by reference.

6.2. Data Retention: To ensure system performance and security, we implement a data minimization policy. Inactive workspaces and associated data may be purged after 12 months (365 days) of inactivity. Automated version snapshots are retained for a maximum of 6 months.

7. FEEDBACK & INTELLECTUAL PROPERTY

7.1. All rights, title, and interest in the Products remain with Bobcat Planners. No ownership rights are transferred through purchase.

7.2. Feedback: You may provide us with suggestions or feedback regarding errors or improvements ("Feedback"). You acknowledge that Bobcat Planners may use such Feedback without any obligation of confidentiality or compensation to you. You grant us an irrevocable, perpetual, world-wide license to use and incorporate Feedback into our Products.

8. REFUND POLICY

Please refer to our separate Refund Policy for details about our no-refund policy for digital products.

9. TERMINATION

We reserve the right to terminate licenses for violation of these terms, unauthorized distribution, or attempts to circumvent security measures. Upon user request for account deletion, all personal data and cloud-stored content will be purged immediately from our active databases.

8. GOVERNING LAW

8.1. These terms shall be governed by and construed in accordance with the laws of Quebec, Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts in Quebec, Canada.

8.2. If you are a resident of Quebec, you may have additional rights under Quebec's Consumer Protection Act.
